Terms and Conditions for Luggage Transport for Tourists GR 92 "Camino de Ronda"
In the event of a conflict, only the German version is binding. Version of 11/15/2022 The present General Terms and Conditions are intended to govern the contractual relationship between CostaBravaTaxi, based in Plaza CatErina Albert, 1 2º 2ª in 17185 Vilobi de Onyar ES-Spain, VAT no. ESX 1484753 (hereinafter "the Service Provider") and its customers (hereinafter "the Customer") regulate within the framework of a baggage transport service for foreign or domestic visitors during a travel stay (on foot or by bicycle) between one or more consecutive stages of the Camino de Ronda GR 92
1. Purpose of the contract
The purpose of the contract is:
(a) the carriage of one or more items of luggage1 (suitcases, rucksacks, panniers, travel bags, etc.) partially or throughout the GR92 “Camino de Ronda” hiking trail, with the exception of items not related to a leisure trip (furniture, tools, household appliances, etc.)
(b) to settle the prior reservation within the period specified in point 2.
2. Reservation
Each reservation must be received online by the customer at least 10 days before the start of the first stage in writing (CostaBravaTaxi booking form) and guaranteed/confirmed by the service provider.
3. Baggage
The customer is responsible for ensuring that all luggage can be easily transported/moved. The maximum weight of a piece of luggage must not exceed 15 kg. Each piece of luggage must be completely locked. Open bags, backpacks, etc. will not be transported. A luggage tag for identification must be attached to each piece of luggage in an easily recognizable and legible manner. The customer can download this from the service provider's portal. Only pieces of baggage with fully completed baggage tags will be transported.
4. Transport / Collection - The transport of luggage is guaranteed
(a) Within the same day on the stages of the GR 92 “Camino de Ronda” that can be booked with the service provider (collection no later than 12.00 p.m. at the point of departure and delivery at the point of destination by no later than 4.00 p.m.)
(b) From and to any commercial/commercial accommodation located on the GR92 “Camino de Ronda” and capable of receiving visitors for overnight stays (hotels, guesthouses, youth hostels, campsites, holiday apartments, rentals, etc.) The collection or delivery at a train station, airport or any other public place is only on request from the service provider and at a special rate provided for this purpose.
(c) The Customer must ensure that someone is physically present and available by telephone when baggage is collected at the point of departure and when baggage is deposited at the point of destination. He undertakes to do so by clicking the appropriate box on the reservation form. If the luggage cannot be collected (entrance locked, no precise identification, absence of the person, etc.), the contract between the service provider and the customer is considered terminated and the luggage remains at the departure point. The costs incurred for this will be 100% charged to the customer (No show) If nobody is present and nobody can be contacted when the luggage is deposited at the destination, the service provider will keep the luggage and transport it to the next destination/or its facilities, where the customer can pick it up. There are special fees for this, which are billed according to the effort in volved.
(d) Simple and easy "handling" of the baggage during collection / delivery must be guaranteed within reasonable limits. The customer must ensure that the luggage does not have to be moved more than 50 meters from the pick-up or delivery location.
5. Cancellation and "no-show".
Any booking must be canceled in writing (e-mail). Cancellation is accepted free of charge up to 48 hours before the first luggage transfer. All amounts paid are 100% refundable. If cancellations are received within the 48 hours, the service provider will charge 15.00 for each cancellation as an administrative expense. The remaining amount will be refunded to the customer. There are no refunds for "no-shows" (bookings where the driver does not find luggage at the departure point).
6. Special Rules / Exceptions.
In exceptional cases, one or more people can be “transported along” with the luggage if:
(a) there is sufficient space in the vehicle for luggage and the person(s) to be carried.
(b) the point of embarkation and disembarkation of the person(s) is on the same route.
In any case, this arrangement is NOT included in the price and is only offered by CostaBravaTaxi with the consent of the taxi driver(s). There can be no claims to implementation
of passenger transport.
7. Fees and Extra Baggage
In the 2023 season, the luggage transport service will be billed according to the tariffs specified on the service provider's website. The service is only provided for the number of bags specified in the booking (maximum 5 bags). If the driver finds one or more additional pieces of luggage that were not specified in the booking, carriage of all luggage cannot be guaranteed unless the customer guarantees the payment of the additional amount. (approx. 7.50 euros per piece of luggage)
8. Force Majeure
The Service Provider shall not be liable if the non-execution or delay in the execution of any of its obligations described in these General Terms and Conditions is the result of a case of force majeure. Force majeure as such means any external, unforeseeable and irresistible event within the meaning of Article 1148 of the Civil Code.
9. Processing of personal data
Each contract concluded between the customer and the service provider may involve the collection by the service provider of personal data from the customer, the processing of which is necessary for the performance of the contract and/or compliance with legal obligations. Any comunication of personal data to third parties or subcontractors will be carried out in accordance with Spanish law and European Union law, including the General Regulation on the Protection of Personal Data (No. 679/2016/EU). The customer declares that he is informed that he has the right to access and rectify his personal data at any time, as well as the right to refuse the processing of his data, with the consequence that the service provider then reserves the right to refuse to enter into a contract with the customer if said data is necessary for the performance of the contract.
10. Final Provision
The service provider reserves the right to change these general terms and conditions. Changes are only binding for the customer if he has been properly informed before the contract is concluded.
11. Applicable
Law These general terms and conditions are governed by Spanish law.
